Tripura Gears Up for Implementation of New Criminal Laws!

Agartala, June 29: In a significant move, the Tripura government has initiated a mega awareness campaign to educate citizens about three newly formulated criminal laws set to come into effect on July 1, 2024. These laws – the Bharatiya Nyaya Sanhita (BNS), Bharatiya Nagrik Suraksha Sanhita (BNSS), and Bharatiya Sakshya Adhiniyam (BSA) – mark a major overhaul of the state’s legal system.

Enhanced Protection & Streamlined Processes

The new laws prioritize citizen safety, particularly for women, children, and vulnerable groups. The BNS, replacing the Indian Penal Code, introduces stricter punishments and introduces community service as an alternative for specific offenses. Additionally, citizens can now file FIRs at any police station, irrespective of jurisdiction, with the option for e-filing.

Focus on Efficiency & Transparency

The BNSS, replacing the Code of Criminal Procedure, ushers in an era of electronic investigations and proceedings. Importantly, the new legal framework mandates communication of investigation progress to complainants within 90 days, followed by trial commencement within 60 days of chargesheet filing. Verdicts are also stipulated to be delivered within 45 days, uploaded online within a week, ensuring transparency.

    • Replaces Indian Penal Code (1860)
    • Reduced sections from 511 to 358
    • Community service for specific crimes
    • Seven new crime categories
    • Death penalty for rape of girls under 12 (Section 65(2))
  • BNSS:
    • Replaces Code of Criminal Procedure (1973)
    • Electronic investigations and proceedings
    • E-statements recognized as written statements
    • Police empowered to attach properties acquired illegally
    • Arrests for petty offenses involving disabled/elderly may be exempted
  • BSA:
    • Replaces Indian Evidence Act (1872)

Training & Infrastructure Upgrade

The state government is committed to smooth implementation. Over 2,347 personnel across police, law, and health departments have undergone training (online and offline) to effectively handle cases under the new laws. Upgradation of infrastructure, IT systems, and recruitment are also underway to support the transition.

Public Awareness & Legal Aid

District-level awareness programs are being conducted to educate the public. The State Legal Services Authority is actively involved, ensuring citizens understand their rights and responsibilities under the new legal framework. Law Secretary Sanjoy Bhattacharya clarified that pending cases will be addressed under existing laws, while the new laws will apply to incidents occurring from July 1, 2024 onwards.

Tripura is preparing for a new chapter in its legal system, prioritizing citizen safety, efficiency, and transparency. This mega awareness campaign is a crucial step in ensuring a smooth transition and empowering the public with knowledge of their rights.
