New Delhi, January 27, 2024: The Supreme Court is scheduled to hear the dispute arising from conflicting orders of a single-judge bench and a division bench in the matter of fake caste certificates in West Bengal. Chief Justice DY Chandrachud will lead a five-judge bench in a special sitting today to address the controversy surrounding the Calcutta High Court’s recent decisions.
The case, titled “In Re: Orders of Calcutta High Court dated January 24, 2024, and January 25 and Ancillary Issues,” stems from disagreements between the single-judge bench, led by Justice Abhijit Gangopadhyay, and the division bench headed by Justice Soumen Sen.
Justice Gangopadhyay accused Justice Sen of acting in favor of a political party in West Bengal, leading to conflicting orders on the fake caste certificate matter. The single-judge bench directed the CBI to initiate a probe, disregarding the division bench’s order.
Alleging that Justice Sen’s actions were aimed at protecting a political party in power, Justice Gangopadhyay labeled them as misconduct. The dispute originated from a petition in the High Court, alleging the widespread issuance of fake caste certificates for admission to medical courses.
On January 24, Justice Gangopadhyay instructed the West Bengal Police to provide relevant documents to the CBI. However, the division bench, led by Justice Sen, later stayed this order. The single-judge bench persisted, directing the police to hand over the documents, leading to a disagreement with the division bench’s decision.
The matter has become a legal tussle, with the Supreme Court now set to intervene and address the conflicting orders to ensure a fair resolution to the controversy over fake caste certificates in West Bengal.
